The Study Of Legislation On Hunting Of Wildlife In China

The hunting is a traditional activity with human evolution and also the most primitive way of utilizing wildlife. Today, the hunting has become one of projects of sport and tourism, which embodies the meanings of entertainment, keeping fit, promoting economic development and so on. Many countries all have separated legislation on hunting in the world. However, our country being the one of countries which possess the most abundant wildlife varieties, involved in the content of hunting only in the chapter of "wildlife management" of ((wildlife conservation law)) , which regulations were general and not specific, let alone the management of hunting fields. Obviously, all these couldn't meet the need of practical hunting management. Although internal many scholars had suggested legislation on hunting, they only expressed the idea in their articles and didn't make systemic elaboration on relative questions. There have done little of work on the study of legal questions existed in the practice of wildlife hunting management. Consequently, this subject not only in theory research, but also in practice application has remarkable meaning.In this paper, the necessity of legislation on hunting of wildlife was discussed firstly. The constructions of hunting law of wildlife was provided from the facets of legislation purposes, basic principles, basic contents, legal responsibilities, supplementary provisions and so on, which based on developments and conditions of managements of internal wildlife hunting were analyzed and experiments of managements of external wildlife hunting were introduced and referenced. To perfect shortcomings of current laws and regulations, make up for blanks. Practically, to revolve the legal questions existed in hunting managements, to regulate hunting behaviors, to reasonably utilize wildlife resources, to meet consumption demands and promote economic development. From long term, it intents to secure the harmonious development between human and nature, maintain the ecological balance and promote the continuous development of national economy.
