Construction On Wild Plants Protective Law Of Our Country

Sincel980's, the convention and sustained harness have appealed common attention of the international society, and became a hot spot of the global environment convention. As a vital part of biodiversity, wild plants not only play a big role in ecological balance, but also have great value in economy, science research and civilization.Since 1984, more than 100 international treaties, multilateral agreements, and bilateral agreements on wild plants convention have formed. It was that time wild plants convention began to be concerned. In 1996, our state council have published WILD PLANT PROTECTIVE REGULATIONS OF REPUBILC OF CHINA, which is a special administration code regards wild plants as the protective target. Nowadays, under the situation that the wild plants are seriously damaged day by day, WILD PLANT PROTECTIVE REGULATIONS revealed many defects. Therefore, this paper adopts many study methods, such as comparison method, literature method, fieldwork method, spot survey connected with concrete evidence, and so on. And proves the necessities and concrete suggestion of constructing a WILD PLANT PTOTECTIVE LAW.The paper introduces the concept, meanings, development of wild plants protection and the status of our country. And introduces some legislation on external wild plants convention. Among the domestic laws, the paper summarized some legislation in USA, Australia, and Russian. Among the international treaties, introduces ESA, CBD, CITES, IPPC, and EUHSD.And then, sums up the legislation system and the concrete stipulation of wild plants convention in our country. And compared WILD PLANT PROTECTIVE REGULATIONS OF REPUBILC OF CHINA with ESA from the following sides, such as legislation stylistic rules and layout, management system, organization setting, protective range , and stipulation on CITES and finally concludes the experiences for constructing our wild plants law.Furthermore, takes apart and studies the problems in management system, legislation system , executing the law , legal liability. Say, because the power can't be carved up clearly, so liability can't be correctly fulfilled. Some legal systems are too lagged and distempered to execute. In the process of executing law, it works a lot of problems due to the stipulation on power plotting and procedures are not very rigorous. It also works many people defy the law to damage the wild plant badly. Because the stipulation on legal liability is incomplete. And prove that by analyzing the problems of Lantsang drainage area.Finally, the paper probes into the meaning, instrument and amendment, and studies out a draft of WILD PLANT PROTECTIVE LAW of our country.
