The crime of theft or illegally excavating and robbing cultural relics means crime of stealing (cultural property) and crime of illegally excavating and robbing ancient cultural sites or ancient tombs. China possesses rich cultural relics and a large amount of cultural property disappears each year, which means a great loss to our country. The loss of cultural relics originates in the crime of theft or illegally excavating and robbing cultural relics. This article throws light on the problems of legislation and administration of justice in the crime of theft or illegally excavating and robbing cultural relics. It makes a thorough inquiry historically and makes a comparison between crime of stealing (cultural property) and crime of illegally excavating and robbing ancient cultural sites or ancient tombs then shows connections and differences between the two. It also discusses the two crimes separately in the respect of criminal structure, crimes or not, criminal type and so on, points out the weaknesses in the legislation and puts forward a legislative proposal to make penalty for these two crimes perfect This aims to make a progress in the field of preservation of cultural relics and improve the system of penalty in our country.
