The increase of China's motor vehicles has, on the one hand, enhanced the people's livelihood and, on the other hand, brought great damages to the safety of life and properties. This has been followed by controversies over no-fault liability as stipulated by Article 76 of the Road Traffic Safety Law, which went into effect on May 1, 2004. The present thesis looks into some major issues regarding damage compensation in road traffic accidents. Starting from the history and present condition of China's system of damage compensation in road traffic accidents, it draws on related foreign theories and practical experiences to make a comparative study on damage compensation in Chinese background. Major issues discussed cover the rationality of no-fault liability, contributory fault on the part of the victim(s), and two urgent issues in handling road traffic accidents, i.e. the subject of compensation liability and corresponding compulsory insurance for motor vehicles. This research is meant to contribute to the establishment of a system of road traffic accident damage compensation suitable to China's situation to ensure the interests of the victim(s), which will add to the fairness and justice of law and to the harmonious development of society.
