Study On The Legal System Of Water Resources

Water is the source of life, and it plays a fundamental role in the societal development. At the same time, the whole world is concerned with water crisis:cataract and drought, lack and waste, or pollute and abuse. The main content of the dissertation is the way to fulfill the legal system of water resources, including the property right system, the moving system, and the administer system. According to the analyses and advice on legal system of water resources, the intent of this dissertation is to advance the sustainable development of water resources, and realize a harmonious society between human and water. The dissertation is divided into five chapters: The first part of the article is the groundwork of the latter, comprised by the characteristics, meaning, and value of water resources, the theory of the sustainable development, and the expatiation on the legal system of water resources. The meaning and characteristics of water resources can identify the object of water resources law; the value is a base of the property right system, the moving system, and the administer system. The water resources law should affirm the right and interests on water resources, and advance the droit marketing, while the value in environment should be also affirmed. The two should be treated identically; under the guidance of the theory of sustainable development, the legal system should be perfected, concerning the property right system, the moving system, and the administer system. The second part is the analyses to the property right system of water resources. Under the theory of "property right", this part discuss the property system and the water right system, character the use right and contaminated right, and discourse the water right on country. The third part is the analyses to the moving right system of water resources. The content include the water price system and the tread system of water right, involved the infection to the third-party in water tread, the tread of contaminated right, and water right on country. The forth part is the analyses to the administration system of water resources. The part pays attention to the pattern, gist of the administration system, and discusses the valley administration system and the redeployment system of water. The last part summarized the thesis, and put forward with the role of the law system to realize the harmonious society between human and water.
