Brief Discussion Of Compound Technology Barrier

Under the tide wave of globalization, China entried the World Trade Organization (WTO) in 2001. The traditional tariffs have been weaken because of the trade libertarianism sponsored by the WTO. However, Technology Barrier to Trade (TBT) and Intellectual Property Barrier(IPB) have been strengthened at the same time. A lots of multinational companies use the present law frame and will develop their markets to gain the max profit in this way: "technology patentization , patent standardization, standard monopolization". Many Chinese enterprises will experience or are experiencing the storm of TBT and IPB. The development of intellectual property makes itself been the certificate of market admittance. Traditional labor advantage will lose its importance in this competition step by step. There are amounts of patents within the high technology field. Patents technology accelerate the industries'structure optimization and the international competition. Many technology standards have to embody more know-hows, patents. Patent standardization has been the main method of monopolize the global technologies. At the present time, few scholars study the effects of TBT and IPB to trade.In the paper, I just call the TBT and IPB as Compound Technology Barrier (CTB). CTB is not the simply piled up TBT and IPB. It is the compound of technology standard and intellectual property (mainly refer to patent in the paper). The first chapter sums up the background and main purpose of writing this paper. Base on the characteristics of TBT and IPB, the second chapter puts forth the definition and characteristics of CTB. In the third chapter, I analyze the influence of TBT and IPB to the international trade, then explain the technology standard and patent included in the DVD case, finally posts the impact of CTB on the real trading. There are some suggestions and strategies for enterprises and government to deal with the CTB in the last chapter. My purpose on writing this paper is: to awake people's consciousness of protecting intellectual property, to be an alarm to other industries through the analyzing of DVD case, to be a reference when the government and enterprises encounter such kind of barriers in the future.
