Research On Perfecting The Anti-Dumping Legal System Of China

By using the theory of jurisprudence of Economic Analysis and Comparative law, this paper reveals the defects existed in our anti-dumping legislation. The author also suggests that China must take for reference overseas' practice in regulation-formulating, clauses-determining and procedure-implementing so as to make perfect the current Anti-dumping Regulations.There are four parts in this paper:The first part: the development of the anti-dumping legislations. Based on the analysis of the harm of dumping to the economy, it demonstrates the necessity and impendency of anti-dumping and points out the development and tendency of the anti-dumping legislations of the world.The second part: the status and problems of china's anti-dumping legislation. It's mainly about the analysis of the problems that existed in legal system in China.The third part: Comparative study of the disparities between WTO, European and the U.S.A anti-dumping rules. This parts takes the relevant laws issued by the WTO, European Unions and the U.S.A as examples and makes the comparative analysis of the anti-dumping laws in foreign countries and points out that the experiences draw from that play the important role in perfecting the anti-dumping laws in China.The last part: Some advice on perfecting legal system of anti-dumping in China. To compare one anti-dumping mode in foreign countries with another and use the experiences of the legislation concerning anti-dumping for reference, this part puts forward some advice on the legislation of anti-dumping in China.
