In the informational society, computers and their network have made beneficial contribution to the human being, while the illegality and crime of network of computer quickly spreads, involving every field of the society with gradually increasing damages. Facing the overspreading of illegality and crime of computer network, most countries in the world have taken measures to punish and prevent the crime of computer network, Hechi City in Guangxi Province where the author lives inevitably suffered the corrade of crime of computer network. On the basis of investigation and combining the working practices, the author writes the dissertation of Investigation on Status of Illegality and Crime of Network in Hechi City. The dissertation includes three parts. Part One introduces the general situation of the development of network in Hechi City. Hechi City lies in the northwest of Guangxi Zhuangku Autonomy Area and belongs to the Gesite area of southwest of China. The registered customers connecting network in this city are more than 48200, and the rate between wide band customers and population is about 1:79, while the national rate is 1:50, so it is seen that the popularization of network in this city is lower than the national average level. Part Two is about the current situation and reasons of network crimes in Hechi City. The author holds that network crime is the act that the subject uses computer network to commit the conduct with serious social damage which violates criminal law and shall be criminally punished. The types of network illegal crimes cases in Hechi City are various, including network swindle, gambling, stealing, pornographic act, transferring sales and spread of bad information. The characteristics of illegality and crimes of network are: the culture degree of the persons who commit network crimes is mainly high school or technical secondary school; the types of network crimes mainly include network swindle and gambling; the persons involving in crimes are obviously low-age. The tendency of network crimes in Hechi City shall be as following: the crimes and illegality of network shall be gradually socialization, the quantity of network illegality and crimes shall continually rise, the criminal character of network crimes shall be gradually serious, the damage to the society shall be more serious and new type of network crimes may appear. The reasons for which network illegality and crimes in Hechi City are various, jural idea is weak and fluky mind is also one reason; secondly, the controlling power is not strong, the prevention and strike of network crimes lack of power; and then the legislation about network is seriously lagged; fourthly, the social idea exists mistakes; finally, application is emphasized instead of safety, high-tech supervisory management ways are relatively lagged. Part Three is about the preventive strategies of network crimes in Hechi City. Although nowadays juvenile adults are not the main group of network crimes in Hechi City, the experiences tell us that, the prevention of network illegality and crime shall start from juvenile adults, and aiming at the actual situation of juvenile network customers, take the directive measures. The prevention and strike of network crime in Hechi City shall take following measures: I legislative aspect: to make relative perfect laws, and provide full legal functions for the prevention and strike of network crimes. II judicial aspect: "only by law it is hardly perfectly smooth", about such high-tech crime of network crime, the preventive measures are especially difficult and shall strengthen the power of punishment by law. III technical aspect: network crime is a kind of high-tech crime, a kind of intellectual crime, to prevent it will require applying some new high-tech ways in the technical measures. IV social integrated controlling aspect: about thenetwork crime, the crime controlling plan for integrated shall stick to, and combine the moral restraint, technical prevention and criminal punishment. Firstly, pay attention to the moral construction of network society, secondly, build regulated network technique management system, thirdly, deepen the administration on internet bars, build long-effective safety management technology measures, fourthly, break the boundaries between departments and fields, form the situation that the whole society cooperates to strike network crimes.
