The most essential start of the supervision on administrative law enforcement is to make administrative enforcement of law be serious and just, guarantee state administrative organizations and the functionaries uncorrupted, just and highly-efficient, then achieve the purpose of administration by law. Customs is the state administrative organization, modern customs system puts forward higher requirements for the function of administrative law enforcement of customs, and this kind of requirement involves each tache and field of administrative law enforcement and includes the new-style customs administrative ideas, advanced customs administrative system, mulriple-type customs administrative function and high-intellect and energy-saving customs administrative technique and ways matched with modern customs system. However the customs administrative law enforcement of our country needs to be further perfected no matter in the level of administrative legislation or in administrative law enforcement system, supervisory restrictive working system and the quality of personnel of administrative law enforcement. To strengthen the supervision on administrative law enforcement is not only the requirement of modern customs system and the customs administrative law enforcement after China's entering into WTO, but also decided by basic spirit of theory of constitutionality, the intrinsic characteristics of administrative power and the characteristics of the specialization of customs law enforcement. The author expounds the developing tendency of customs administrative law enforcement under the modern customs system, subjectively analyzes the current situation of customs administrative law enforcement, and discusses the necessity of administrative law enforcement supervision, on the basis of which the author combines her own working practices and puts forward the suggestions and strategies: â… to strengthen and improve the customs legislation, advance the customs legislative level, including creating new ideas, to correctly control the relationship between legislation and enforcement from four aspects; to establish the coordinative system, feedback system and consultation system of state laws and policies maker departments; correctly confirm the legislative position of customs head office; to make the directly subject customs become the positive advisor, beneficial complement and provider for information of customs legislation. â…¡to actively promote the reform for the current customs administrative system from five aspects: to establish cost idea, re-define three grades of customs functions, reduce the internal examination and approval and smooth the internal relationship; to break the artificial separation of customs areas, and realize the regional management model; to strengthen the relationship and negotiation with related department; to actively participate in the reform of international customs management system, and increase the law enforcement idea of using external assistance. â…¢to further establish and perfect customs administrative law enforcement supervision working system, the perfecting including supervision by law, re-new law enforcement ideas; to establish the customs administrative law enforcement internal controlling system mainly directed by risk management, to strengthen the authority of supervisory power, to confirm and perfect external supervisory system. â…£to establish wide individual self-restrictive system, including establishing modern administrative idea, correct ethic principle and construct customs uncorrupted culture. â…¤to actively and gradually promote the reform of customs business basing on the balance of controlling of reform and administration by law.
