With the rapid development of the net game, net space has resulted in some problems, which is vacant in law; fictitious property is one of them. Fictitious property has the common attributes of the legal property. It also has some special attributes, such as non-agelong existence and continuation and non-consumptive use. Therefore, a great deal of disputes and their legal settlement being the focus that all circles discuss actively.Based on retrospect the different phases and their character of legal questions about fictitious property in the network games, this paper emphasizes the legal character of the fictitious property and the legal attribute of the property of fictitious assets. After analyzing three different viewpoints about the attribute of fictitious property, the author considers that the property of fictitious assets in the network games is a kind of property which has the attribute of real right and must be ruled and protected by the civil law.In fact, many foreign countries have stipulated laws to protect fictitious property. The law of property is one of the core "institutions" in legal system, providing the requisite certainty and stability for planned activity in a free market. As with any institution, internal inconsistencies and paradigms abound. As electromagnetism record, the things in net game, eg weapons, money, house, have been protected in some countries and district. Our country must recognize this form of property by law and protect it.
