Research On Monopoly Control System

Antimonopoly law is considered the centre of economic law in a market economic country. It is reputed to be the "Constitutional" in the field of economy. Antimonopoly law is the fundamental measure to control monopoly in the market economy. As the central system of antimonopoly law, the monopoly control system has decisive impact on the orientation of antimonopoly law, that whether structural principle or proceeding principle will be adopted in the antimonopoly law. The structural principled monopoly control system is a system ruling the centralization of a trade, while the proceeding principled monopoly control system is a system ruling the conduct of the leading enterprise.Now China stays during the key period of system reform and economic development, so it is necessary for us to draft and apply antimonopoly law. Presently, proceeding principle is adopted in China. The paper researches into issues on relation between protection for fair competition and economic development, protest against administrative monopoly, and difference between exceptions of application and administrative monopoly by studying on current status of litigation of antimonopoly law as well as economic development and by learning experience all over the world.
