China's Antimonopoly Control Subjects Research

The issue of the regulatory object of anti-monopoly law has long been the primary theoretical problem all anti-monopoly laws tend to solve. The discussion over the issue has its particular theoretical and actual significance when our anti-monopoly law is in brew.Anti-monopoly law's regulatory object refers to the monopoly anti-monopoly prohibits, limits and bans, and all acts curb competition, which is the essence of anti-monopoly law. There is no uniform criteria as to the definition of monopoly, because monopoly is a concrete and historic concept and in accordance with specific productivity level and specific state economy policy. It's generally thought that monopoly is the state and act enterprises and other organizations use economic or non-economic measures to exert exclusive control over production and market in economic activities as to curb competition. That's to say monopoly is the monopolized state of controlling the market, as well as the monopolized act of curbing competition and abusing privilege. In light of our state features, economic globalization and contemporary development of anti-monopoly law, the regulatory object of our anti-monopoly law should be the monopolized act of curbing competition and abusing privilege, with regulatory scope including official monopoly, and economic monopoly and transnational corporation as well. However, anti-monopoly law doesn't ban all competition-curbing acts for its duality, those acts with more positive effects than negative effects should be exempted as an exception.The whole thesis is composed of three parts based on the above.
