The Ideal And The Reality

Since the first existence of the press, it has been deeply influenced social life and the every aspect of national politics during the past four hundred years, and became the significant pillar to make society advancing. Hence, the freedom of the press has been an ideal destination of the democratic government ruled by law.However, the conflicts between the ideal freedom and the real sequence are still existing, especially in the construction of our socialist state ruled by law and the market economy nowadays, the cases of ideal of the press freedom collides with the reality are striking: the freedom does not be guaranteed strongly, and squander the freedom occurring now and then, infringement of the freedom as well.To solve the conflicts and achieve a real freedom of the press, we should bring it into the construction of ruled by law, make the press conducted under the law, make it protected and limited by law. Taking advantage of the press and limiting its disadvantage depend on the solving of two relative key factors: there are laws to abide by and ensure that the laws are strictly observed, therefore, that is what we will discuss in this paper.The introduction gives a brief summarization of social and academic background mentioned in this paper.The first part of the paper begins with implication of the press freedom; define the specific rights which concluded in the press freedom. Then, tracking back to the origin of the theory, furthermore, analyzing the value contained in the press freedom.The second part gives a discussion of the conflicts between the ideal and the reality: because of the lagging of the law construction and the deficiency of legal norm, press freedom, the fundamental value in the society of democracy is still absent and misplaced in China. The rights of press freedom clashing with other rights, and can not be solved effectively and properly. The limitation from the administration also leads to the result: the rights of interview and report can not be achievedThe third part raises necessary ways to solve the problems mentioned above ,make the freedom ideal come true , and construct harmonious press legal sequence in China, that is: enact specialized press law, establish reasonable regulation to specialize conflicts, And there must be laws to abide by, ensure that the laws are strictly observed at the same time.
