The Modern Judicial Idea And Civil Justice Reforms

The modern judicial idea has brought great positive effect on the operation of the civil procedure system. The modern judicial idea's contents mainly include the judicial authority, judicial justice judicial independence, the protection of human rights .judicial transparency,and judicial high efficiency,all of which are rooted in the analysis of the essence of the modern judicial idea. The modern judicial idea carries the characteristics of serving for people, modernization, ideality,and development. The modern judicial idea in our country has experienced the process of transplanting the western judicial idea blindly and of reasonable nationalization,and embodies of passive, popular,international trends.This dissertation analyzes the present situation and the idea of foreign civil justice reforms with British and German examples .which is based on the study on the relationship between the modern judicial idea and civil justice reforms.This dissertation discusses the enlightenment of foreign advanced idea on our civil justice reforms from the perspective of the modern judicial idea.In addition, the dissertation considers the civil justice reforms which is based on the modern judicial idea,combining with the analysis of the effect of our civil justice reforms and of the lack of the the modern judicial idea,in order to achieve the harmony of the modern judicial idea and civil justice reforms.
