Research On The Legal Problems Of Electronic Agency

Since the establishment of agency legal institution, it has promoted the ability of individual to do civil action and transact business and reduced the cost of dealings. In the twenty century ninety, the advent of inexpensive yet powerful computers, together with the rapidly evolving data communications network infrastructure, has spawned a revolution in the way companies and, increasingly, individual consumers transact business, which called electronic commerce. In the practice of electronic commerce, a set of automatic systems, such as sophisticated software programs so-called electronic agents, has been used to make decisions and fulfill business objectives intelligently and autonomously, without human interaction or intervention furthers this electronic commerce revolution. The use of electronic agent to make contracts for humans is no longer mere prospect but reality. On one hand, business and individuals use such electronic agents today in a wide variety of roles: from stock trading, to inventory and supply-chain management, to data filtering and information retrieval. On the other hand, the use of electronic agents creates lots of disputes for judges and creates a puzzle for conditional law. Until now, our country not yet established the law protection system of electronic agency, the research of electronic agency in our country is also in an elementary stage. This article utilizes both theoretical research and comparative analysis method, discusses the following problems: the concept and characteristic of electronic agency , the legal relationship of electronic agency ,the constructer and legal effection of electronic agency, the international practice oflegislation about electronic agency . On the basis of theoretical research, the article proposes the legislation of "Law on Electronic Agency" and its article design.
