From the origin of collective agreement and its historical development in western countries, wecan see the important of its status in social lives and the reasons why it has development into a basicsystem in the western world. In china, the system of collective agreement has development for manydecades, but not yet ach a satisfying effect. The situation is caused by some factors such as ourcountry's trade union policy, collective bargaining system, stipulations of collective agreement itself,worker's right to strike and the function of the government. Since China has accessed to WTO, it isimperative that we perfect our collective agreement system.This paper attempts to research into the complete aspects of collective agreement, on the basisof combining theory and practice, while comparing the foreign collective agreement system and thepresent law and regulation on collective agreement in China. This paper tries to analyze the factorswhich influence the system of collective agreement, expecting to perfect the system step and toprotect the labor's right and interests practically and effectively. We can take such measures asfollows: to establish the mechanism to safeguard the trade union's independence, to expend thescope of the subjects in collective bargaining, to acknowledge the prevailing and continuing effect ofcollective agreements, to define the unilateral liability of collective agreements, to stipulate worker'srights to strike in laws and to initiate the positive role of the government.
