On The Background Of Civilization And Culture Of The Origin And Development Of Environmental Law

The author tries to explore the origin, brief account on development of environmental law according to its background of civilization and culture. And the above determines the writer to use a historical method to discuss the theme. The whole thesis can be divided into the following parts in details: Chapter One explains what is environmental law. In the author's point of view, he manages to get a profound understanding of the definition, feature, and function of modern environmental law by synthesizing all the related knowledge. Chapter Two clarifies the cognition of civilization and culture and their influence on the origin of environmental law. In the author's opinion, the former (material civilization) is the motive power that originates the law and the latter (culture) is the inner motive that breeds and refines the law. Chapter Three historically reviews the background of civilization and culture that originates environmental law. In this part, the writer reviews both the brief history of environment and the process of the origin of Laws. In other words, the writer respectively reviews the background of civilization and culture. And the latter background points out that the origin of environmental law is actually the continuation of Law, especially the continuation of culture. In the end of this thesis, the author briefly analyzes the development of environmental law and its prospect. The infinite development of material civilization and the external continuation of cultural background determine the dynamic state of environmental law from its origin. However, the development still depends on its essence.The writer thinks that civilization, especially the highly developed material civilization, makes environmental problems objective facts. And when these facts seriously endanger the living and existence of the human society, environmental law, the continuation of both Law and culture, will necessarily come into being. The subjective construction of environmental problems has made the cultural background clearer. Working as a procedure or factor of social system, environmental law directs human beings, who control the society with laws, to balance the relationship between environment and economic development in order to gain the most rapid economic development through the minimum harm to the environment. As a selecting requirement and standard of actions in special space or at special time, culture has to face environmental problem all over the world. Certainly environmental law is not only a simple combination between environment and law that are two necessary factors to originate environmental law. At the same time, the infinite development of material civilization is followed by the development of environmental law, and because of the lagging of culture, the development of environmental law should be carried out firmly according to its foundation—"Humanism ".
