Study On Criminal Witness System In Our Country

Witness is the soul of the lawsuits, without it the process of the lawsuits would be no value .It's a certain requirement to acquire justice in a lawsuit that the witness should bear witness in a lawsuit, especially after the reform of Chinese criminal procedure law in 1996.With the deep going of the criminal procedure reform, perfect witness system plays a significant role to make the reform successfully.In order to solve the problem better, it's necessary for us to have a research on the basic theory of witness system first. This paper is tried to compare and analyze the witness system from history and international viewpoints. In the first part, the history, definition, characters and classification of the witness is introduced. Then according to the reality of the witness system in our country, we found out three big defects of criminal legislation: on the aspect of witness giving testimony, the legislative quantity is deficient, and the legislative attribute is contradictory, and the legislative content violates the legal principle. At the same time, the reasons in the cultural traditions and the legislative enforcement should be paid attention to. After that, eight advices are mentioned to better the witness system in our country.It's sure that with the progress of legal civilization all of the unreasonable phenomena will get solved thoroughly.
