Comment On The Crime Of Huge Unidentified Property

As a new crime in the criminal law of China, the crime of huge unidentified property has taken an important role in the struggle against the economic crime among the public officers. But the conflicts still exist in the criminal law studying field, some scholars even insist on a point that this crime should be abolished. From the viewpoint of legislative history and the value of the crime of huge unidentified property, this article gives a positive answer about its value and necessity. And then the writer discusses the constitution of the crime, and some questions disappear in the application of the law, especially the problem of the crime name, subjective elements of the crime, objective elements of the crime and the subject of the crime. This article also explains some questions which were censured by some scholars. In the end, the author gives his own idea of the improvement which can make the crime of huge unidentified property work more efficiently.
