Research On The Problem And Suggestion For Serving A Sentence Outside Prisons

Criminals serving sentences outside prisons include serving sentences outside prisons and changing of sentences, such as conditional serving outside prisons, surveillance, deprivation of political rights, probation, parole and community serving warrant etc. which is common in foreign judicial theory and practice. Criminals serving sentences outside prisons is comprised of all sentences except for imprison, shows completely China's criminal policy, namely the hybrid of punishment and education, as well as humanitarianism. for criminals, which is in favor of their education, influence, rehabilitation, and is in the harmony with the transnational trend of being gentle, humanism and socialized. In respect to the problems in practice and imperfect of legislations, serving a sentence outside prisons does not play a efficient role at the present. Therefore, it is important and essential for reinforcing this work to probe into the problem and examine the channels to improve the relevant legislations.
