In Public Security of China, Penitentiary policing is mainly that barricading or corruption of personal freedom in police of China by the name of Public Security. The penitentiary facilities in Public Security are devided into 5 goals: Labour imprisonment of misdemeanours(or Criminal detention house). Detention house. Public order detention house, Correctional centers. Drug rehabilitation centers. Hospital of criminal lunatic. As the penitentiary policing has begun long ago and been developing by the time, but by now the system of penitentiary policing is not developed well at all. There are so many problems of theory and practice in the penitentiary policing that they directly barrier the actual effect of the penitentiary policing, and . directly barrier the personal right protecting. For this reason, there is more policy in the penitentiary policing and there is little law in the penitentiary policing, so it can't be say that the penitentiary policing is by the law and for the law. There are also few domestic books and articles for the penitentiary policing, but most of them are files, collections or rules of operation which is short of depth in theory. As Mr. Guo Zhenjiu. the vice dieecter of Penitentiary Adminstration Department in the Ministry of Public Security says that "inquiring into the penitentiary policing is blank now".So this article try to describe the concept of penitentiary, retrospect its hiatory, seek out some theorical and practical problems for basic, criticize them, prospect thefuture by the new concept of value and advice of legislation in the course of democracy and legality.
