Several Issues On Executive Law Enforcement Of Environment Protection

In china, people pay more attention on using technical and economic measures to protect the environment. They are lack of deep research and appropriate understanding on the problems, theories and practices of one of legal measures—the executive law enforcement of environment protection. Environment problem has more and more become the restricting factor that influences the development of economy. Although China has rather sound legislation of environment protection at present, many problems exist in its executive law enforcement. Basing on the basic principles of executive law enforcement and using the method of demonstration, comparison, and materialistic dialectic, this paper firstly discusses the historical development and existing problems of executive law enforcement of environmental protection and analyzes the causes of those problems. On this precondition, basing on the realistic needs of executive law enforcement of environment protection, this paper proposes that institution innovation is the breakthrough point of perfecting executive law enforcement of environment protection. And new patterns of institutions such as disclosing system of environmental information, marketing mechanism of protecting environment, and executive contract system of environment protection should be introduced and established. Furthermore, this paper also provides legal considerations for perfecting executive law enforcement of environment protection in China: firstly, integrate environmental law system of China and provide law basis for executive law enforcement of environmental protection;secondly, reconstruct the law enforcement system of environment protection;thirdly, perfect the procedure of executive lawenforcement of environment protection;fourthly, perfect the supervision system of executive law enforcement;fifthly, establish obliging system of executive law enforcement of environment protection.
