The Research Of College Students Management Legalization

With the strategy of running the country according to the law gradually improving, the awareness of rights and the idea of legalization are also entering into college education fields. The collision between the old and new ideas and the conflict between power and rights greatly challenges the work of college students management.Re-examining the fields of college students management from the point of lawfulness, we find the problems existed unneglectable, whose main manifestation is that it is a common phenomenon to intrude on the students'lawful rights in college students management work, for example: actual inequality exists in the work of enrolling college students; the school dismiss students freely, and intrude on the students'rights of being educated; disrespect the students'privacy, and intrude on the students'personality rights; impose fines and collect fees freely, and intrude on the students'property rights; some problems exist in the standard and procedures of evaluating students, and intrude on the students'just evaluation rights; manage and punish students subjectively and randomly without considering procedures, which makes the students'appealing rights and lawsuit rights could not be used effectively, and intrude on the students'procedural rights; intrude on the other rights laid down by the students'laws and regulations.There are many respects as to the reasons of college students managing unlawfully. Macroscopically, the deep reason that leads to its present situation is that the educational legalization is not mature. Our national educational legal system is not perfect, many rules and regulations are set very early, whose contents are rather out-dated and the quality of appealing bad; the process of management and punishment lacks procedural regulations, and the aiding channel of students'rights sometimes blocked; the theoretical realization towards the legal status of colleges and the legal relationship between colleges and students rather vague; as to the particular regulations of colleges, illegal and unscientific phenomena exist in its contents. Microscopically, the backward managing ideas and thin concept of legalization and rights of our educational supervisors influence the concrete choice of manner and method in the process of management. This is the direct reason the makes the phenomenon of intruding on the students'rights happen.The value of legalization is to regard human beings as the center and the final settling place. To realize the legalization of college students'management work, we must fully protect the students'lawful rights and construct a legal system of protecting and safeguarding rights, regarding which as our choices of value.
