In current society with rule by law, the development of education should be oriented to democracy and laws. As the reform in higher education focuses on colleges and universities, and at the core of the various legal relations formed around schools is that between students and them, it is crucial to the reform in colleges and universites' administration systems and standardization of their powers that the legal relations between students and schools are identified and the legal statuses of students and schools are established. This paper's object is to analyze the complex legal relations between students and schools, define administrative juridical relation and civil legal relation, identify the legal statuses of students and schools in the frame of administrative juridical relation and provide approaches to standardize the powers.As a standard study which follows the logical way of thinking of the "problem raising-analyzing-solving", combining the practice research of typical case, the research primarily uses the methods of literature search and comparative research. Epistemologically, the study sticks to the combination of reason and reason limited. The thesis consists of three parts: introduction, body and summary. The first part clarifies the connotation of the realization of student administration ruled by "law" in university. The second part analyzes the actuality of student administration ruled by realization "law" in university. The third part does some research on of student administration ruled by "law" in university.The practice of administrative ruling over university in China can no longer meet the demand of higher education when it is going into the market in the economic globalization. The traditional personal-training conception in the management of students' affairs should give way to the lawful conception, which places rights as the developing and standing point of personal training. In other words, it means to establish the value orientation of standard of rights, to use the degree of the realization of students' rights as the value standard to evaluate our work. We should respect people, care people and develop people to the utmost extent while scientific management is being carried out.
