Path Analysis Of The Legalization Of University Students' Right To Education In China

As a basic right of citizens,the right to education should be guaranteed.As an important part of the right to education,the right to education of college students should also be paid attention to.In recent years,the legalization of the right to education of college students in our country has made some progress,but there are still some deficiencies.The party's overall strategy of governing the country according to law has put forward a new proposition for the protection of the right to education of college students.In 2015,in 2017,the Standing Committee of the National People's Congress and the Education Section did not modify the relevant normative documents on the protection of the right to education of college students.The promulgation of the new law will inevitably lead to changes in law enforcement,justice and other fields.This paper adopts literature research method,investigation method,interdisciplinary research method,case study method.In this paper,the author from the legislative,administrative,judicial,legal culture construction of the right to learn the right to education in colleges and universities of the path of the rule of law.This paper consists of four parts.The first part is an overview of college Students' right to education.The author expounds the basic meaning,content,main body and relative person of the right to education.On this basis,it defines the right to education of college students,and makes clear the significance of protecting the right to education of college students.The second part:the present situation and challenges of the protection of the right to education of college students.Relying on the promulgation of the new law,as well as the author's research data,literature research method,the author separately from the legislation,law enforcement,judicial aspects of the right to education of college students are facing problems and challenges.The third part:the influence of college Students' right to education by the rule of law.According to the second part of the present situation and the challenges facing,respectively,from the legislative,administrative and judicial aspects of the right to education of college students to protect the rule of law is not perfect reason.In this part,the author thinks that China is still facing the special situation of the rule of law in higher education.The last part:to improve the legal protection of the right to education of college students in China.In this paper,the author puts forward the solutions to the problems of the protection of the right to education of college students from the legislative,administrative and judicial fields.
