On Regulation By Economic Law Concerning The Market Medium Organization

Recently in China, with the development and modification of market economy, the market medium organization has been playing a more and more important role in daily economical life. Started by the concept and character of medium organization, this paper discusses the active role and functions which the medium organization performs. In the end, this paper analyzes the legal nature of medium organization and defines the medium organization as economic law corpus. Based on these researches, this paper additionally analyzes the problems of the medium organizations and tries to find out some counter-measures to regulate the medium organization in sight of economic law. In the end, this paper gives some proposal to modify relative registration. For modifying basic theory of economic law in our country, this paper of the medium organization mainly makes use of the research resources of civil law, administrative law, political sciences, economics, sociology, and other subjects to research into the particular subject of economic law--- the medium organization.At first, in chapter one, the author puts forwards the legal definition of the market medium organs.Chapter 2 explains the legal status of the market medium organs and determines it as the subject of economic law. In this section, this paper mainly discusses the possibility of the economic legal status of the market medium organs and gives a fully theoretical analysis.Chapter 3 Introduces the situation of foreign market medium organizations and put forwards some proposals.Chapter 4 explains the problems of the market medium organs as follows: the poor neutrality;loss of whole Programming and disorder of regulatory system;being lack of a sound legal manipulation;declining occupation morals and crashed self-discipline mechanism, and etc. The failure of the market medium organs results in a distortion of the function of the whole economic law.Chapter 5 analyzes the counter-measures as to the regulation on the market intermediary organs. These relevant actions include: perfecting the legal system construction;strengthening the programming and guiding of the government;perfecting the regulatory system;strengthening the self-discipline of the market intermediary organization;manipulating the charges;enforcing the relevant law to the letter.
