The issue of International Labor Standards has gradually become a disputed hot topic in recent years and exists as an unmediated chasm between the developed countries and the developing countries during the new round of multilateral WTO negotiation. With China's accession into WTO and becoming a developing member thereof since 11 December, 2001, the issue of International Labor Standards also puts China in a big test of keeping its WTO accession promise in all aspects. This paper aims to discuss on how to incorporate International Labor Standards into WTO and how to improve the labor law legislation in our country.The first Chapter focuses on the concept and sources of International Labor Standards; the second Chapter enumerates the background and developing tendency of incorporating labor standards into WTO structure; the third Chapter explores the basic principles for incorporating labor standards into WTO structure, including the scope and guidelines for such incorporation of labor standards into WTO structure and the relationship between WTO and ILO after such incorporation; the last Chapter proposes some suggestion on China's approach in terms of labor standards after its accession into WTO.This paper aims to trigger individual concern on the development of International Labor Standards under the WTO structure by analyzing relevant issues in terms of incorporation of labor standards under WTO structure, hence leading to the improvement of the labor law legislation in our country and resulting in the matching of our labor law legislation atmosphere with the requirement of international core labor standards for the purposes of creating better legislation atmosphere for China's participation of international competition.
