Environmental Administrative Subject In Our Country

The environmental problem is one of the most serious social problems that human beings are confronted with in history. The problem that how to carry out the environmental administration in order to uphold the living condition of human beings is required to be solved immediately for all the countries in the world and even for humanity. The environmental administration as a positive and effective management measure under the current situation has been adopted widely in many countries. So the theoretical research and systematical construction of environmental administrative subject, which is the dominate part in environmental administration and the main participant in the legal relationship of environment administration, is becoming even more important and urgent. Hence, this paper discuss the current situation of the environmental administration in our country, the existing problems and the development and improvement of environmental administrative subject theory in our country.Firstly, the author elaborates the development of environmental administrative system, the construction of environmental management in our country and the relative content of administrative subject theory. Besides, the author expounds the feasibility of research of environmental administrative subject theory and systematic constructive in China. At the same time, due to the inherent shortcoming of the distemperedness of environmental administrative subject in our country. For instance, the repeated setup of environmental administrative subject, the weakness of authority of law enforcement and so on.Therefore, it is essential to do some reasearches on this topic. On the basis, the author attempts to investigate some basic problems on the establishment of environmental administrative subject theory in our country, such as, the definition of environmental administrative subject, authority and responsibility, the affirmation of range and qualification. Through the comparision of environmental managemental system between western countries and china, the author put forward some aspects, we can learn and draw on the experiences. Finally, the author proposes that the research of environmental administrative subject theory and systematic construction need to be development and improved further under the new situation of China's entering WTO.
