In 1979, to conform to the trend of economic globalization, China started to practice its basic state polity of Opening-up and Reform. The door of our country was opened to outside. As a result, on one hand, we get a large sum of funds, advanced technology and scientific administrative expertise, which were badly needed by our economic development;on the other hand, a lot of abroad pollutions were transferred into China.At present, Chinese government is paying high attention to the issue of abroad pollution transfer. Because it put our exasperate environment towards a dangerous edge and severely influenced the sustainable development in domestic China, in certain sense, this is also a trample on national sovereignty of our country. Though developed countries have no excuse for their pollution transfer, a great number of problems in our country could not be neglected.In order to effectively prevent abroad pollution transfer, the dissertation proceeds with serious condition of abroad pollution transfer faced by our country, not only demonstrates the reasons for pollution transfer and its nature, but also expounds the confliction between pollution transfer and sustainable development theory. Furthermore, analysis on laws of the domestic and abroad on control of pollution transfer are presented, their advantages and disadvantages are pointed out. The writer believes that this would help China to establish the frame of laws on controlling abroad pollution transfer. However, relying only on means of law, the pollution transfer problem could hardly be thoroughly solved. In this way, other strategies should be adopted, such as establishment of environment tax system, improvement of environment standard and consummation of public participation institution and so on. With the collective strengths of all these measures, the objection of valid resistance to abroad pollution transfer would be achieved.
