On the surface, legal person's copyright in persona is nothing but the right of publication, the right of signature, the right of revision and the right of integration of works enjoyed by legal person in all, which might be directly applied to the traditional theory and doesn't have the need to be discussed separately. But in essence and compared with traditional copyright in persona, it is not only the conversion of subject, but surpasses the idea of its system. It denies the dogma that only natural person can create, and acknowledges the possibility of acquiring copyright in persona by other subjects, both of which shake the old system of theory about copyright fundamentally.Owing to the adherence to the old system and anxiety about the new idea, some scholars question the justifiability and feasibility of legal person's copyright in persona, which made the ever ignored system be denied in many ways. Whether legal person's copyright in persona should exist, whether it could come true, and how should we consider the legislation concerned become the problem we must solve.This paper is divided into three parts.In the first part, we discuss the institutional value and theoretical basis of legal person's copyright in persona.The institutional value of legal person's copyright in persona can be proved by three sides. Firstly, granting copyright in persona to legal person is the intrinsic need of the system of legal person. Secondly, legal person's copyright in persona does not sacrifice overall good of society, but vindicates it instead. Lastly, legal person's copyright in persona advances natural person's creation as well.
