China And South Korea Copyright Legal System Is A Comparative Study

Copyright is an important element in country's soft power. Copyright law as the basic law for the protection of authors' rights and the legitimate use of works, having important affection in the maintenance of good order in the field of intellectual property, as well as promotion the social and cultural development and prosperity, is called "the Basic Law of human culture." As the deepening of the international trade exchange between China and Korea, the copyright economy are also increasingly closed contact, however, differences about two countries in the Copyright law system, result in frictions or disputes in the cultural exchanges and dissemination, affecting the healthy operation on cultural exchanges between the two countries. For these years, China and Korea regarding the copyright and other intellectual property rights, are negotiating and cooperating for the free trade agreement and hoping to learn from each other in order to achieve the consensus in the intellectual property rights in economic exchanges, and to achieve a reciprocity. The paper, regarding to this surroundings, chooses the study on the Copyright Law system compared to the two countries, based on a comprehensive exposition of historical development of the copyright legal system and the copyright basic concepts, from five perspectives, such as the concepts, the copyright restrictions on the use , of system works the right adjacent to ,the protection of foreign works, and administrative and juridical remedies for copyright infringement, analyzes the similarities and differences between two countries, in view to the countries fully appreciation on the series relative law, making up a modest contribution to seek the common ground on copyright protection system and the legislation.
