Based On The Copyright Rights Of The New Network Technology Research

This dissertation gives an account of the copyright protection,restriction and liability principle based on networked technology. It discusses the networked environment structure and feature,the theory of copyright,and the networked technology influencing the copyright. Through summarizing and analyzing the revision of copyright law of our country,the dissertation points out some inadequates. On copyright protection,the dissertation analyzes somemeasures to protect database,puts out the strategy to settle this problem------to stipulate performance of duty of database's legal users,instead of to stipulate special rights of database creators. The article describes how to protect the technological measure and copyright management information too. On copyright restriction,the dissertation studies some questions and tactics about the digital libraries and remote education,makes some ideas andstrategy on copyright restriction in our country------legislators,personsenjoying the copyright protection and persons enjoying the copyright restriction,do their own endeavor,all together. On copyright liability principle,the dissertation introduces the world situation and tendency,analyzes our country's relevant legislation. It puts out some suggestions about our country'slong range planning on liability principle------ to extend the rule of presumedfault liability,develop the rule of fault liability,try out many other liability rules.
