On The Uncompleted Pattern Of Abettor

Uncompleted pattern of abettor is one of the most complicated issues in the theory of complicity. The reasons come from two aspects from the point of view of the study of Chinese Criminal Law. The first one is the disagreement about the nature of abettor; the second is the different understandings towards clause two of item twenty-nine in our present Criminal Law. In the amended Criminal Law, slight amendment has been made to the stipulations concerning complicity in the original Criminal Law. But when it comes to the classification of accomplice and the stipulation of complicity, no virtual amendment was made. While in the academic circles, scholars all depend on the stipulations in the Criminal Law to study abettor from the fact of legislation. This legislation oriented academic study hinder the perfection of the theory of abettor. The studies of theoretical basis is usually the guide of the establishment of institution, and only the institution based on proper theoretical verification is realistically feasible. As the guide of practice, theoretical study should try to reflect the scientificalness and regularity of objects. The dispute about the abettor's uncompleted pattern of conformations has been focused on the understanding of clause two of item twenty-nine in Criminal Law. Then is the stipulation reasonable? Therefore it is necessary to go beyond legislation and offer some rational consideration about abettor from the factual point of view.
