Research On Legal Matters Of Uncompleted-right Houses

Chinese real estate market has been considered a twisted market, and the problem of the uncompleted-right houses is the reflection of it. The problem of the uncompleted-right houses has been more and more prevalent in the course of social and economical development. According to the statistics, uncompleted-right houses have accounted for 20% percent of the real estate market, and the disputes arising from them has been increasing dramatically. The court finds it very tricky to solve the problems and even tries to avoid to deal with them. Many scholars have done massive research on them and the governments have issued policies to settle them, but the problem remains unsolved and becomes more intractable. The paper starts with the conception of the uncompleted-right houses, analyses the cause, background and problems of them, brings forward some suggestions on the basis of our legal practise and relevant policies, and provides the practical methods to solve them on the account of the Land Administration Law.The paper consists of four parts:The first chapter, the conception and category of the uncompleted-right houses. Through the analysis of their background, I set forth the conception and the legal attributes and them and thoroughly analyse their legal essence.The second chapter, analysis of the problems of uncompleted-right houses. Considering the process of their development, i analyse their problems and specify the legal risks of buying them.The third chapter, the causation of the uncompleted-right houses. Analyse their causation in the view of social and legal background.The fourth chapter, how to solve the problems. I analyse the existing problems of the uncompleted-right houses in the view of legislation, legal practise and state policies. At last I bring forward some practical suggestions on how to solve the problems.
