A Reflection On Tightening Up The Legal System Of The Organization Of Institutions In China

As is known the establishment of the legal system of the institution organization began in the early stage of New China, however, the correspondent law, administrative regulations and local rules have not been systematized, although Constitution and Organization Law of central and local governments were sanctioned a long time ago and have been amended several times through decades of years. Up to present, China hasn't enacted a comprehensive law or legislation on the organization of institutions, which is incongruous with both the present condition and the historical mission given by the organization administration in China.The establishment of the legal system of the institution organization has undergone three major periods. During the first period from 1949 to 1954, general rules for central government and local governments at all levels were formulated and organization regulations of some departments were sanctioned according to"Common Program of the CPPCC"which then took the role of temporary constitution of China. During the second period from 1954 to 1965, the first Constitution of China was issued, organization laws for State Council and all local governments was decreed, and organization regulations for the departments of State Council were published, which brought the legal construction of the Chinese administrations into its golden age in the first a few years of this period. The following ten years turned out to be a blank stage resulting from the chaotic social state caused by"Cultural Revolution."The third period started from 1976. Since the reform and opening up of China, the Central Government has promulgated the new Constitution, abridged the organization laws for State Council and all local governments and reconstructed the legal system of institution organization."Administrative Mechanism...
