Social mobility is the common phenomenon in the human society. The social mobility of"peasant workers"is an unique phenomenon in China during the transformation of social structure. It is an important result of economic reform and also a necessary prelude of Chinese modernization. At present, although many scholars have done many researches about social mobility of"peasant workers", they only analyzed them from sociology and economics, but the discussions are few from legal regulation about social mobility of"peasant workers". In this article I analyze the appearance, reasons and status quo of"peasant workers"and try to rethink, improve and prefect law strategies of social mobility on the"peasant workers"through interpreting and reviewing the policy and law that our government made out for the social mobility of"peasant workers"in order to protect their legal rights and regulate social mobility of"peasant workers"by law.This article is divided into four parts. Firstly I define the meaning of"peasant workers"and social mobility. Secondly I briefly describe the history, status quo and reasons. Thirdly I point out that it is necessary that social mobility needs legal regulation. Lastly I propose strategies of legislation, enforcement law and judiciary through interpreting the policy and law made by government on"peasant workers".The first part is the definition and researches about social mobility on"peasant workers". In this part, I first define the meaning of"peasant workers", it means that the man has got a job in the city and gets salary, but their identity is the peasants and they have labor capabilities."Peasant workers"is the combination of the identity of the"peasant"and the job of"worker". They left the farm land but did not leave their villages; they went to the factories but not to the cities. Although working in the city and taking part in every jobs, but for the urban residents, they are still peasants. As a result, they can neither blend into the urban society nor return to the rural community. They can only be on the move all the time from the urban to the rural.
