Study On The System Of The Real Property

Universal areas in foreign developed countries and districts have become increasingly prevailed in the mortgage of the real property, which is a method of circulating necessary funds that debtors collect the bank loan in the term of the pre-building, building, built commercial residential buildings as guaranties. The mortgage of the real property is embodied in inland legal practice in the beginning of 90s,and it turns more widespread. By reason of the difference between the two major legal systems in the world, inland theorists have not been attuned to mortgage. That is the reason that I choose mortgage systems as my graduation dissertation. In the dissertation I study on the notion of mortgage, the origin, the effect, the nature of the contracts of mortgage, and the distinctive national features concept —Mortgage Insurance. In the end if the designer have sight of the whole guarantee legal system, then we must account on the nature of mortgage as one specialized typical guarantee formation. If the designer turn inclined to the merchandise of the real property, we should account on the former legal frame in order to the harmony of practice and theory.Zhang Chunyan...
