With the development of economy and city planning in China, the urban building demolition is unavoidable. The urban building demolition started after foundation of China, however the real large-scale old city reformation and urban extending begun from for 90's in 20 centuries. Recently the topic of the urban building demolition has become the hot issue among people. However because of various reasons, the process of the urban building demolition became very confusing. The words "The tender demolition "and" the popular support engineering" is mention rarely. Recently the medium always mentions a lot of malignant affairs caused by the urban building demolition, such as the violent demolition happened in Jiahe, Hunan province and related demolition happened in Qingshui, Gansu province. Currently the illegal demolition and compulsory demolition is separated gradually. It seriously infringes the people's basic rights, also breaks constitution and law. It seriously breaks the construction of the harmonious socialist society. Confront with the serious situation, it is necessary to explore the source of these disputes. Only by doing so can we solve this problem and achieve the harmonious socialist society.This article based on administrative law and by probing to the nature and meaning of the urban building demolition. This paper analyzes the topic of the demolition and the source of the antinomy. By researching the legal adjustment mechanism on the urban building demolition, this article analyze the irregularity of the act regulations and the circulate the mode relate to the building demolition.
