Legal System, Human Right And Constitutional Government

The Supreme Court has the supreme judicial authority in a state, which has the supreme judgment function as well as the strong social controlling power. It plays an essential role in unifying legal system, protecting human rights and ensuring the implement of the constitution.This article analyzes the basic function of the Supreme Court by choosing three different aspects—legal system, human rights and constitutional government in comparing the functions of the Supreme Courts in different countries, the first of which is that the Supreme Court can put down the confliction and maintain legal system. And the second function of the Supreme Court occurs to protect basic human rights and the rights of the minority .The last but not the least function of the Supreme Court appears to interpret constitution and ensure the implement of the constitution. At last this article expatiates in the actualities and the demerits of the Chinese Supreme Court in executing those functions and makes some suggestion to perfect it.
