Research On The Civil System Of Counter-charging

Civil system of counter-charging has been stipulated in our nation's civil lawsuit .In recent ten years,the system has made great progress ,but the result of the system is not so good because of the imperfection of legislation and all kinds of difficulties which appears in judicial practice,the effectiveness of the system is converse to the purpose of the legislation.so there is a depute in academia. some scholars think existence of the system is unnecessary.Here penman will emphasize the importance of the system and analyze the present situation of legislation.In same time,penman will raise some means of reformation.The article are divided into five parts,and has approximately thirty thousand entries.In the first part"quotation",introduces the purpose and meaning of writing this article.The second part is the"sketch of civil system of counter-charging".This part primarily deals with some questions as follows:(1)Analyse of the concept and characteristics of the system;(2)The meaning of the system's existence;(3) The situation of the extraterritorial system. In the third part,simply introduce the circumstances of the system's depute about abolishment and existence;we will comparate the difference between our system and foreign according system.In the fourth part,penman analyze the problem of our system.In the fifth part,penman will talk about the reconfiguration of the system.
