On Public Facility In Administrative Law

In modern society, with the change of the function of the government, it has become a very important task for a nation to provide the best service to its citizens. Correspondently, performance administration is growing gradually among the administrative activities. It is of undoubtful significance to study public facilities, which is a very important object of performance administration. The thesis gives a clear definition to"public facility"in China based on the comparative analysis of the definitions of it in other countries and areas."Public facility"is the artificial object or the object equipment which is owned or managed by the administrative subject and which is for public use. Based on this definition, this thesis compare"public facility"with some related concepts like public property,public utilities,public products, public course, public places. It analyzes the features and types of public facility ,and the history of it in the next parts, which is followed by further probe into the connotation and extension of it. Four constitutive requirements of it are fully discussed: aim, subject, power(right)and substantial factor with an attempt to expound the static profile of"public facility". The following part explains the three stages of running a"public facility", establishing, managing and abolishing, with exemplification of current laws in China. The last part is about the seven different relationships established in using"public facility": free use, use under permission, use under franchising, use out of custom, use beyond the aim, contract-like use, impulsive use as well as the remedy for the use of"public facility"and for the loss caused by the use of"public facility".
