A Discussion On The Establishment Of Legal System On Rural Cooperation In China

The cooperation is the outcome of market economy evolved from merchandise economy. To change their disadvantages in the market competition, the feeble volunteered to join up and founded the cooperation for reducing the exploit of middleman. As part of the feeble in market economy, the farmers run a risk of natural-ties ,at the same time, they run a risk from market competition too. As a result , the rural cooperations become more essential and more popular between farmers, and the rural cooperations become a majority of the cooperation family. The development of cooperation has nothing to do with the sociopolitical system. Where there is market economy, there is the likelihood of appearance of cooperation. The historical development of cooperation is more than 160years. In many developed western country, the rural cooperation system is quite mature, and become part of legal system . Along with the market economy established in China today, the market competition puts farmers at a serious disadvantages. Then people attach importance to rural cooperation again. The purpose of this paper is to do something helpful to the establishment of the legal system on rural cooperation ,which would guide the rural cooperation founded in reason and regulate the rural cooperation work all right, and the foundation of the legal system in Chinese country.This paper refers to the field of law ,sociology ,economics and so on ,with the research ways and means such as historical study ,comparative analysis,demonstration investigation .Chapter One introduces the academia of this topic .Chapter Two introducs the historical development of cooperation, the general situation of the cooperation system and the legal system of it .Chapter Three studies the successful system of cooperation in other country, the history of international cooperation and the innovation of cooperation,namely new generation cooperations .Chapter Four studies the status quo in the country in today china . Logos become more and more popular in farmers ,and the tradition"acquaintance society"in China country is changing . The establishment of rural cooperation is imperative under the situation. Chapter Five analyses the cooperative ability of Chinese farmers ,the feasibility and the necessity of establishment of the legal system on rural cooperation. After learning our historic lesson and using the overseas successful experience for reference, the paper makes suggestion that modify the Article Eight of People's Republic of China Constitution as one of macroscopical measures, endow the cooperation with lagal status as one of microscopical measures ,and establish a classical coorperation absorbed the advantages of the new generation cooperations. In conclusion, the legal system on rural cooperatione in China would be established businesslikely and effectively .
