Research On Our Country's Legal System Of Rural Social Assistance

Rural social assistance system, which affords poor farmers who cannot maintain minimum life becauses of all sorts of reasons relieves and services, and ensures their basic life, is a kind of security system, in accordance with the procedures prescribed by laws of the state and society. It is the important part of social security system. In recent years, although in Chinese academic circles there are a lot of literatures in the study of rural social assistance system, which research visions and depths are also expanding and deepening, few author presents to construct a new type of rural social assistance system, and they lack deepgoing and comprehensive researches on its establishment and feasibility analysis. A lot of related research literatures only involve the basic material aids of the rural social assistance system, hardly consider to combine the rural social assistance and the solution of rural absolute poverty and how to overcome poverty problem.Our country is a large agricultural nation. To solve the problem of rural social assistance system is the important task of establishing and perfecting a rural social security system and the important guarantee of building a new socialist countryside. The establishment of rural social assistance legal system accords with the situation of our country, also reflects the basic rules of the social security system construction. The establishment of Chinese rural social assistance legal system, on the one hand, is conducive to ensure the weak community in the impoverished rural areas the basic rights of existence; on the other hand, is conducive to guarantee the rural social stability. Rural social assistance legal system has the important practical significance to solve the issues of"agriculture, farmer and rural area", alleviate the question of the farmers'poverty, safeguard social fairness and promote rural economic stable development.This topic firstly studies the major characteristics and basic contents of present our country rural social assistance system as the starting point, and then generally dialyse the evolution course of our traditionally rural social assistance system and its'present situation. Using the contrast and dialectical methods as the main research methods, this article meticulously and overally analyzes the present predicaments of Chinese rural social assistance system, then puts forward the system selection and specific contents to construct Chinese rural social assistance legal system and come up with some countermeasures and thoughts to perfect our country's rural social assistance legal system by referring to the social assistance system construction experience in some developed countries, in order to clear the idears of solving the issue of our rural poverty. I expect that this graduation thesis can offer some ideas and the basises to the related researches, and I expect that I can make personal modest contributions to the theoretical research and practical operations of current Chinese rural social assistance law system.
