By probing into the basic theories of the legal protection of trade secret, referring to TRIPS and using for reference the related regulations of England, America, Japanese and other countries, the article aims at expounding and proving the legal protection of trade secret, as well as offering individual ideas and viewpoints on itIn the first chapter, compared with the corresponding regulations in other countries, it makes clear of the Chinese concept of trade secret and expounds its constitutive requirements, including being secret, being valuable, being practical and being kept secret by having taken specific measures.It is strongly and commonly of morality and necessity to protect trade secret legally. In the chapter the author interprets the principles of morality respecting trade secret protection, which include principle of non-aggression of others' property and principle of good faith.The legal protection of trade secret should get improved and developed with the occurrence of more and more various infringing acts, which, containing getting or disclosing illegally trade secrets and etc., are set forth in detail in the third chapter. It also demonstrates the determination standards for torts and the problems that people should pay attention to.The following is about the legislation and administration of law at present in China, in addition to the existing problems in this field.
