Reproductive right is a fundamental human right. Reproductive right from moral perspective includes the freedom enjoyed by individuals to give birth or not and the freedom of choosing in quantity, timing, quality, mode and sexual distinction. From the group perspective, the behavior of giving birth is a kind of blindness in action, which had made reproductive right quite special. Therefore, free exercise of it would cause a huge growth of population, which make the right of development and the right of environment can not be realized. Centering on reproductive right, there have been a controversy between developed countries and developing ones. The debate centers on, in order to seek economic and social development and reduce the pressure on resources and environment by growth of population, whether it is legal to impose restriction on human behavior of giving birth so as reproductive right can only be exercised within the legal framework. The western developed countries, proceeding from the fact that no interference into private and family life is a fundamental right, stand the freedom of individuals in birth is most valuable which should not be interfered by the nation with the excuses of law, regulation and policy. Some developing countries, based on the facts of high birth rate and huge population, insist to give priority to the rights to survival and development. This author believes: repoductive right view of western developed countries which advocate individual freedom goes against the norms acknowledged by the international law. As the < World Declaration on Human Right > states, individuals has the duty to the society as only in the society can his personality can be tapped freely and fully. The behavior of giving birth involves the public interested recognized by the public, therefore it does not belong to the field of private life.
