In recent years,Chinese family planning policy is frequently adjusted by the contradiction between family planning policy and laws.This civilization has the right to bear the relative freedom of the laws and regulations of our country's right of birth.This paper shows that there are problems such as the protection of reproductive rights,the only obligation of family planning but lack of constitutional protection of reproductive rights;the defect of protection of laws and regulations relating to reproductive rights,the legislature to emphasize the obligation of family planning ideas to develop the reproductive right laws and regulations,protection of reproductive rights focus on family planning obligations set,and the “population and family planning law” allows the province, autonomous regions and municipalities directly under the people's Congress or its Standing Committee specific the number of children,resulting a problem that the number of children between differences provinces are different,and this difference runs counter to the principle of fairness under the system of constitution,especially the conflict among the plan and the legal protection of reproductive rights and family planning policy.To solve the problem,it is recommended in our country from the angle of constitutionalism starting to protect the right to procreate,deal with the relationship between the planned birth policy and laws and regulations,clear plan effect order between family planning policies and laws and regulations,policy guidance, laws and the basis of regulations,the Constitution and the population and family planning law "and other reproductive rights protection in the proposed amendments to the reasonable and scientific.
