With the development of digital technology, the traditional is increasingly converting into the digital one. Its original objective to serve the reader isn' t altered, even if the service modes have changed through which readers can gain the information easier than the past one. However, one problem is confronted during the construction of digital library: some services probably are conflicted with the copyright law. The paper that mainly focuses on a series of problem during the process of construction and service specifies whether or not the fair use principle can exist in the environment of digital library, and the confliction can be resolved in the framework of fair use, and discovers the method that can work out the confliction.This paper consists of introduction, main text and conclusion.The introduction briefly shows the purpose of the paper and the problems that will be discussed.The main text includes five partsThe first part: the summarization of digital library and the fair use of copyright law. In this part, library is defined as the commonweals library containing the public library, university library, scientific research institution library and so on. The part not only specifies the meanings, characteristics and the similarity and differences on the fair use between the digital library and traditional one, but also point out the basis of philosophy of law to apply the fair use at the library.
