Inspection On Private Attribute Of Our Commercial Registration System

In 2004, Study of Commercial Law Conference of China Law Society has held the annual session, scholars and experts has fully explored the status quo and the conception of our commercial registration system, so we can see that the registration system for our commercial research vital theoretical and practical significance. It also reflects another aspect that there are many worthy research and improvement in our current commercial registration system. Experts and scholars attention to these deficiencies : (1) Our commercial registration legislation is decentralized and administered by too many departments, it lacks in harmonization of legislation and concept. (2) Our decentralizing commercial registration legislation leads to a very serious phenomenon of differential treatment of non-uniform. (3) The legal of our commercial registration norms with strong colors of the planned economy and too lights on the value of public private value. (4) The existing procedure of examine and approve is too excessive and indiscriminate for lacking of effective law. (5) The entity qualification is combined with the operating qualification, market withdrawal mechanism is not sound.
