Study On The Application Of Law Of Internet Copyright Infringement

The appliance and development of the new network technology makes great effect on the intellectual property law. The effect is composed of three respects: the content and the media of message can be separated, this makes the special character of the copy right not very obvious; the quickness of the information exchange challenges of time character of the copyright; the globalization of the internet makes the location character of the copy right not very clear. In the respect of the international private law, as the inter net gives the copyright have some new characters, the traditional tort law cannot handle the new problems very well. In this paper, the author analyses and discusses the appliance of the traditional principle of law appliance of the cyber copyright tort and the connection. Based on this, the author makes some introduction and comment on several propositions of law appliance of the cyber copyright tort, so as to make some suggestions to reform the law appliance of cyber copyright tort.The whole paper is divided into four chapters. The first chapter analyses the nature, concept, basic character, subject, object and content of the copyright, and the influence of traditional copyright made by the cyber space. The main difference between works in the inter net and the traditional works is the form of the work. The works in inter net take digital media, which is not different from traditional works. So the works in the inter net is protected by the copyright law. The copy right in the inter net has the character that it is unique and can be copied.
