The Study On The Legal System Problem Of Real Estate Investment Trusts In China

A REIT is a company that owns, and in most cases, operates income-producing real estate such as apartments, shopping centers, offices, hotels and warehouses. Some REITs also engage in financing real estate. The shares of many REITs are freely traded, usually on a major stock exchange.Recently, real estate industry developes very fast, while it barges up against bottle-neck of the capitals. China is in store of huge capitals, but short of the high returns investing channels. Real Estate Investment Trust (REITs), being the link of capital and investment, is often discussed by the people in the fields of finance and real estate. But all the discussions are not so profound, especially having no general introduction on the development of REITs in America. Sometimes, REITs is misunderstood and confused with other conceptions.Backed by the overall introduction of developments and the effects of the legal system of the REITs industry in America/Asian and Eupore, the paper intends to describe and disclose the legal system problem of developing REITs in China. Furthermore, the necessity, possibility and model selections are discussed in the paper.In the end of the paper, some suggestions are gived.There are four sections in the whole paper. In the first section, the paper introduces the necessity of widing the channels of Real Estate Financing and the meaning of developing REITs in China. It introduces the theoretical synthesis about REITs and analyzes the current status and inadequacies about the research of REITs, pointing out the logical framework and methods of analysis of this article.The second section generally presents the relations between the legal system and the development of REITs in the world. At first, it analyzes the development of the American REITs and the changing of the REITs legal system, pointing out the relationship between them and the requests of American REITs. Then it analyzes the development of REITs in Asin and Europe and the effects of the legal system in those countries.
